Release and Waiver of Liability

This Release and Waiver of Liability (the “Release”) is executed on this day of 2020 by (the “Client(s)”) in favor of Anne Dwyer individually and doing business as Health and Harmony and its directors, officers, employees (collectively, (“Anne”). The Client wishes to engage Anne’s services as Holistic Health Coach and as certified by the American Association of Drugless Practitioners. The Client understands that Anne’s services include coaching of the “Ten Day Detox” of Dr. Mark Hyman,  “The Twenty One Day Detox” of Dr Mark Hyman, “Hormone Reset”, “Five Day Cleanse”, “Two Day Juice Cleanse”, “Four Day Cleanse”,  “Three Day Intermittent Fasting”, grocery store tours, pantry detox or individual coaching sessions. The Client(s) does hereby freely, voluntarily and without duress execute this Release under the following terms: Waiver and Release: Client(s) does hereby release and forever discharge and hold harmless Anne and her/its successors and assigns from any and all liability, claims and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Anne’s coaching of Client. Client understands and acknowledges that this Release discharges Anne from any liability or claim that the Client or Guardian may have against Anne with respect to any bodily injury, personal injury, illness, death or property damage that may result from Anne’s services for Client, whether caused by the negligence of Anne or her/its officers, directors, employees, or agents or otherwise. Client also understands that, except as otherwise agreed to by Anne in writing, Anne does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury or illness.  Assumption of Risk: The Client(s) understands that Anne’s services and/or the detoxes or cleanses  may cause unpleasant or adverse effects, and Client hereby expressly and specifically assumes the risk of injury or harm and releases Anne from all liability for injury, illness, death or other damages resulting from Anne’s services and/or Client’s participation in the detoxes or cleanses and/or other services.  Other: Client(s) expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Massachusetts, and that this Release shall be governed by and interpreted in accordance with the laws of the  Commonwealth of Massachusetts. Client agrees that in the event that any clause or provision of the Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
